Abstract

The article analyzes the essence of the concept of evidence that is inadmissible due to violation of the principles of criminal proceedings. Researchers' views on the concept of inadmissibility of evidence have been studied. The main grounds for declaring evidence inadmissible due to non-compliance with the principles of criminal proceedings are considered. Of particular note is the institution of evidence, which is characterized by such criteria as admissibility and inadmissibility of evidence. Today, the issue of declaring evidence inadmissible in criminal proceedings remains controversial. This necessitates the systematization of the grounds for declaring evidence inadmissible under various criteria. A large number of violations of human and civil rights and freedoms in criminal proceedings indicate the shortcomings of the legislative regulation of certain issues in the Criminal Procedure Code of Ukraine (hereinafter – the CPC). That is why the law should clearly regulate all procedural actions in such a way as to minimize possible human rights violations. In judicial practice, there are many cases when evidence is declared inadmissible due to non-compliance with the principles of criminal proceedings.
