Participation of the representative in civil legal relations

The article considers the issues of the participation of a representative in civil legal relations. It is determined that the institution of representation plays an important role in civil law, providing additional opportunities for participants in civil relations to exercise their rights and obligations. The importance of this institution is due to the fact that under certain circumstances individuals can not personally make a deal or perform any other legal actions. In particular, this applies to cases due to the state of health of the person, the scope of his legal capacity, etc.
The peculiarity of representation is that the representative performs legally significant actions aimed at realizing the subjective rights and legitimate interests of the persons represented.
The representation is divided into contractual and legal on the grounds for its emergence. For the emergence of a contractual representation, it is necessary to express the will of its participants (representative and the person represented), which can be expressed by concluding contract of agency or issuing a power of attorney. Legal representation arises regardless of the will of the representative and the person represented.
In order to perform his functions, a representative must be endowed with certain powers, which constitute a set of rights and obligations of the latter. In the case of contractual representation, the scope of powers of the representative is determined by a power of attorney or contract. In accordance with Part 1 of Art. 238 of the Civil Code of Ukraine, the representative may be authorized to perform only those deals, the right to perform which has the person he represents. Legislation also defines the relationship in which the representative cannot participate.
The expediency of legislative regulation of the issue of determining the scope of rights and obligations of the representative in order to prevent abuse by him and to avoid undesirable consequences for the parties to civil legal relations is specified.
