Abstract

This article considers aspects of the use of modern information technologies and technical means in the administration of justice. It was noted that one of the ways to improve the judicial system is the introduction of electronic justice.

The purpose of the article is to determine the role of modern information technology in the judicial process and to clarify the current state of their use.

The authors of the article emphasize that litigation based on the use of modern information technologies is a way to dematerialize the judicial process, improve administration, ensure full access to justice and meet reasonable deadlines.

The authors point out that the coronavirus pandemic has made adjustments in the process of e-litigation, as for a long time Ukraine, like the rest of the world, has been experiencing crises in various spheres of life due to quarantine conditions. Accordingly, the Ukrainian government was forced to impose a number of restrictions to prevent the spread of COVID-19. Given these circumstances, the issue of citizens' access to justice without the risk of infection and compliance with quarantine requirements is particularly acute. Also, the use of modern information technology becomes especially important in the context of exacerbation of problems of staffing of courts. In this situation, the active implementation of the Unified Judicial Information and Telecommunication System is extremely important. The norms of procedural legislation have been studied in order to determine the principles of functioning of the Unified Judicial Information and Telecommunication System.

The analysis of indicators of use of modern technical means in judicial process by local general courts is carried out. It is concluded that the low level of use of technical means to record the trial in administrative and civil proceedings, as well as the number of cases in which the proceedings were carried out by videoconference.

It is emphasized that e-justice is a promising area for improving the judicial process, but it faces various problems. The inhibitory factors that do not allow the e-justice system to function fully are substantiated and the relevant author's conclusions are made.
