Regulatory activity in the sphere of social security for persons with disabilities

Abstract

The article examines issues of normative activity in the field of social protection of persons with disabilities. Attention is focused on the purpose of rule-making, which consists in the formation of legal norms regarding a certain group of relations, namely, their modeling from the state's position.

It is emphasized that the subjects of rule-making are the subjects whose powers are directly directed to the adoption, change or cancellation of normative legal acts.

It is noted that after Ukraine's ratification of the UN Convention on the Rights of the Disabled, the formation of an institutional environment for the realization of the rights of the disabled took place in Ukraine, in particular, the current regulatory and legal acts gained further development, and a number of new legislative acts were adopted, which directly affected the increase in the level of rehabilitation of the disabled.

It was determined that, despite the existing regulatory framework in the field of social protection of persons with disabilities, there are still problems of rule-making, in particular, the issue of the realization of the rights of disabled persons is presented in documents of different legal force and subordination.

It was concluded that a significant problem remains the fragmentation, imperfection and inconsistency of legislative acts in the field of social protection of persons with disabilities.

It is emphasized that the regulatory legal act must belong to a certain legal field, cover the subject of regulation and correspond to the scope of regulation. Regulatory legal acts in the field of social protection of persons with disabilities must necessarily include legal norms directly within their competence, without duplication in other regulatory legal acts. At the same time, this normative legal act must be clearly formed, drafted clearly and qualitatively, and must be consistent and concise in structure.
