Some questions regarding freedom from self-disclosure as one of the principles of the criminal procedure

Abstract

A detailed analysis of the provisions enshrined in the Criminal Procedure Code of Ukraine regarding criminal proceedings against minors was carried out. A number of procedural errors during the implementation of such proceedings are identified and various ways are proposed to avoid their further commission by subjects of criminal proceedings in practice. In particular, the issue of their violation by the prosecution: the prosecutor, the investigator, and operationally authorized employees was investigated in detail. The opinions of various scientists, both Ukrainian and foreign, regarding the most problematic and actually debatable issues regarding procedural nuances and specific features of conducting criminal proceedings against a minor have been studied. Based on this, this article highlighted a number of positions regarding the improvement of the current criminal procedural legislation with the sole purpose, in all cases: to increase the level of protection and provision of rights, freedoms, as well as the legitimate interests of a person, first of all, a child, which are actually provided as The Constitution of Ukraine and the Criminal Procedure Code of Ukraine from 2012.

Separation from general criminal proceedings into separate proceedings for the investigation of an exceptional category of cases involving children is an extremely progressive step for Ukrainian legislation. Because the legislator, in this way, wants to create the best conditions for determining both all the circumstances necessary for a fair resolution of the situation, the circumstances of the criminal offense itself, and to avoid negative effects on the mental health of minors. Achieving this balance is an extremely important step on the way to the formation of Ukraine as a truly democratic, social and legal state. A country that aspires to a bright European future while learning the bitter Soviet experience.
