Current state of legal regulation of social insurance in Ukraine

The article substantiates the relevance of studying the current state of legal regulation of social insurance in Ukraine in the context of guaranteeing the constitutional right to a decent life and free development of a person. This research paper draws attention to the problem of expediency, completeness and perfection of legal regulation of social insurance in Ukraine in the context of current socio-political events.
Based on the results of the analysis of the legislation regulating social insurance in Ukraine, we have identified a number of problems in this area: lack of a sufficiently developed terminology at the legislative level; lack of a general legal act which would consolidate the concept of social insurance, its types, general principles, goals and objectives; lack of complete legislative regulation of certain elements of social insurance; underestimation of some sources in the system of legal regulation of social insurance. The article outlines the prospects for improving the social insurance sector in Ukraine in the form of proposals based on positive foreign experience.
A promising vector for the development of legal regulation in the field of social insurance can be taking into account the positive experience of leading European public social insurance companies regarding such a category of persons as self-employed persons.
The experience of France and Great Britain, which at one time not only encouraged people to self-employment, but also provided financial support during the so-called «transitional period» (a period when a person is no longer in employment, but has not yet established own business that brings sufficient income on a regular basis within the framework of social insurance programs. Social insurance in these countries was also aimed at the fact that periodic payments from the state to individuals enabled the latter to obtain the necessary qualifications and establish their own business.
The integration of the best practices of European states into their own social insurance systems can contribute to increasing social stability and the development of flexible forms of work in different countries, providing citizens with not only economic but also social protection at various stages of their life and professional career. The development of innovative programs and mechanisms of social protection for self-employed persons can contribute to balanced economic development and ensure flexibility in forms of employment.
