Institutional and legal determinants of modernization of the unified judicial information and telecommunication system in the conditions of digital transformation of justice

The article examines the institutional and legal determinants of modernization of the Unified Judicial Information and Telecommunication System (UJITS) in the context of digital transformation of justice. The relevance of the research is determined by Ukraine's ratification of the Ukraine Facility Plan, which identified the digitalization of the judicial system as a priority area of reforms, as well as the need to modernize UJITS by 2027. The technical audit results revealed significant shortcomings in the existing system, which requires scientific understanding of ways to modernize it. The absence of a comprehensive scientific analysis of institutional and legal aspects of UJITS modernization in the context of Ukraine's international obligations actualizes the need for this research.
The purpose of the study is to reveal the institutional and legal determinants of UJITS modernization and determine ways to improve the effectiveness of its implementation considering Ukraine's commitments under the Ukraine Facility Plan. The article analyzes the evolution of theoretical and legal foundations of UJITS functioning, from simple digitization of existing processes to comprehensive digital transformation of justice. The study characterizes a new institutional mechanism for modernization through the establishment of a Project Office at the State Judicial Administration of Ukraine and the implementation of OKR methodology, supported by international technical assistance and cooperation with leading donors.
The research examines the functional architecture of the modernized system, which provides for the comprehensive interaction of functional and technical modules to ensure automation of all judicial processes. The main problems of implementing the modernized UJITS are identified, including obsolete infrastructure, the complexity of integrating different modules, and the need to update procedural legislation. At the same time, the system opens significant prospects for improving the efficiency of justice, enhancing access to justice, and ensuring its transparency.
The article provides science-based practical recommendations for improving the UJITS modernization process, considering both legal and technical aspects. The successful implementation of these recommendations will contribute to creating a modern electronic justice system in Ukraine that meets European standards.
