Liability of legal entity of public law for breach of tort obligations

Abstract

The Civil Code of Ukraine stipulates that the right to create legal entities under public law belongs to the state (state-owned enterprises, state educational institutions) and territorial communities (eg utility companies) in cases and in the manner established by the Constitution of Ukraine and the laws of Ukraine.

As the issue of legal liability of legal entities is poorly understood today, there is an urgent need for a theoretical and legal analysis of this subject and the introduction of new provisions in civil law.

In civil law, legal persons are either responsible for contractual or tort obligations.

Liability for tort obligations is a consequence of causing harm in a legal relationship that is not governed by a contract that is associated with the occurrence of a tort obligation. On tort, the offender is obliged to fully compensate for the damage caused, and the other party has the right to demand from the offender the harm to fulfill this obligation.

Torts are one of the most common types of civil liability, and include damage caused by accidents at work, in the home, unlawful acts by officials and individuals, man-made disasters and accidents, which could be caused not only to health but also to personal non-property benefits - honor, dignity, business reputation, property interests of individuals and legal entities.

According to the provisions of the current civil law, an individual or a legal entity in the event of harm to another person (natural or legal) undertakes to compensate for the amount of damage or in kind (convey a thing of the same type and quality or repair the damaged thing) or compensate for the damage caused .

The article deals with the concepts and features of public law entities. They are classified according to the theoretical and legal approaches of various civil scientists. The grounds of occurrence of legal liability of legal entities of public law are investigated. A thorough characterization of the concept of tort liability, its classification based on the research of theoretical lawyers.
