Peculiarities of providing free legal aid for military personnel under martial law

Abstract

With the introduction of martial law, the announcement of general mobilisation on the territory of Ukraine, and an increase in the number of military personnel, a lot of legal issues have arisen regarding mobilisation, military registration, passing the military medical commission, service, leave, and dismissal, which has led to servicemen applying to free legal aid centres and the need to ensure access to quality and qualified legal aid for servicemen.

The article examines the peculiarities of providing free legal aid to servicemen under martial law. It is noted that all military personnel and members of their families have the right to receive free primary legal aid. Secondary legal aid can be provided to servicemen who are war veterans and their family members, including combatants, persons with disabilities caused by war, and war veterans.

The author highlights the legal services available to servicemen and women, as well as the main issues with which servicemen apply to the subjects of free legal aid: issues of contract service, mobilisation; medical issues, issues of material and social security; issues of payments, benefits and compensation; issues related to the status of combatants; issues of land allocation; housing issues, labour issues, pension issues. 

The author concludes that today one of the main responsibilities of the State is to ensure the exercise of the right to legal aid by military personnel. Not only the development of an effective policy in this area, but also its implementation remains a priority for Ukraine.
