Protection of corporate rights by notaries during the period of martial law in Ukraine

The article deals with the peculiarities of protection of corporate rights by notaries during the period of martial law in Ukraine.
It is noted that with the conduct of martial law at the beginning of the war in Ukraine, strict restrictions were imposed on the exercise of corporate rights of citizens of the Russian Federation and legal entities that are created and registered in accordance with the legislation of the Russian Federation, legal entities that are created and registered in accordance with the legislation of Ukraine, if the ultimate beneficial owner (member, participant (shareholder), having a share in the authorized capital of 10 percent or more, were citizens of the Russian Federation or legal entities established under the legislation of the Russian Federation.
The legal acts, which introduced the adoption of various measures to protect corporate rights, are analysed, such as: moratorium on the certification of transactions that can facilitate the fulfilment of obligations in favor of the Russian Federation, power of attorney, certification of the authenticity of the signature on documents without the use of special forms of notarial documents, termination of access and restriction of user access to unified and state registries, notarization of valuable property notaries, which is on the list of the Ministry of Justice.
It is concluded that the adoption of these measures significantly changed the conditions for notarial actions and emphasized Ukraine's efforts to protect its national interests in difficult conditions of war, demonstrated its determination to counter economic and legal manipulations that can be used against the state sovereignty and territorial integrity of Ukraine. These measures have also proved important in strengthening the legal system and raising the level of responsibility in the field of corporate governance, providing a new dimension of security and stability under martial law.
