Legal status of rehabilitation institutions of the Ministry of Defense of Ukraine

The scientific study is devoted to determining the peculiarities of the legal status of rehabilitation institutions of the Ministry of Defense of Ukraine. The current legal acts, which establish the legal status of rehabilitation facilities, sanatorium-resort facilities, and health care facilities, have been analyzed. The legislation regulating the procedure for providing rehabilitation assistance to military personnel is characterized.
The legal status of the Ministry of Defense of Ukraine's sanatorium-resort (rehabilitation) institutions is governed by the procedures for their establishment, operations, provision of medical and rehabilitation services, and utilization of property in line with their intended purpose.
The peculiarities of the legal status of sanatorium-resort (rehabilitation) institutions of the Ministry of Defense of Ukraine are revealed. Such institutions are established to provide medical rehabilitation and sanatorium treatments. It is indicated that the legal basis for the medical rehabilitation and sanatorium treatment centers activity are such laws as: 'Basics of the legislation of Ukraine on health care'; 'On rehabilitation in the field of health care'; 'On the rehabilitation of persons with disabilities in Ukraine'; and 'About resorts' It is concluded that the centers of medical rehabilitation and sanatorium treatment have the status of legal entities under public law, health care facilities, and sanatorium-resort facilities. It is stated that rehabilitation departments and sanatorium-resort facilities of the Ministry of Defense of Ukraine can provide rehabilitation services only with a license. Such institutions are established in the organizational and legal form of budget institutions or state commercial enterprises.
Amendments to the current legislation are proposed to improve the legal status of the centers of medical rehabilitation and sanatorium treatment of the Ministry of Defense of Ukraine.
