Jury trial in criminal proceedings: theoretical principles and realities of application in Ukraine

Abstract

This article explores the theoretical foundations and practical aspects of introducing the jury system in criminal proceedings in Ukraine, which represents an important element of judicial reform. The study highlights that the jury system is one of the oldest legal institutions that contributes to increasing the transparency of justice, strengthening citizens’ trust in the judicial system, and reducing political influence. The article primarily focuses on the introduction of the jury system in Ukraine, specifically the mixed model, which involves both professional judges and jurors in criminal cases that may result in life imprisonment. The research discusses the key challenges Ukraine may face during the implementation of this institution, including the need for juror training, financing of the system, and potential risks related to emotional or unjust decisions.

The article also examines the positive potential of the jury system in transforming approaches to criminal trials, particularly in improving argumentation from both parties and developing standards of evidence. An important part of the study is the discussion of how the introduction of the jury system can affect the legal culture in Ukraine and foster citizens’ responsibility for the administration of justice.

The author emphasizes that for the successful implementation of the jury system in Ukraine, it is essential to consider the experiences of other countries, develop educational programs for jurors, and ensure adequate funding for the proper organization of the judicial process. At the same time, a clear legislative framework is necessary for the effective functioning of this mechanism in Ukraine.
