Legal Regulation of the Activities of State Executive Service Bodies

The article examines the current state of legal regulation of the activities of state enforcement agencies in Ukraine. The author argues that effective enforcement of court decisions is an integral part of the rule of law. It is noted that the imperfection of the regulatory framework, conflicts and constant changes in legislation complicate the work of state enforcement officers.
Key legislative acts that determine the legal status and powers of state enforcement agencies are analysed. Particular attention is paid to the Law of Ukraine ‘On Enforcement Proceedings’, in particular its articles regulating enforcement measures, seizure of property, foreclosure and other enforcement actions. The significance of the Law of Ukraine ‘On State Guarantees for the Enforcement of Court Decisions’ in ensuring the binding nature and financial support of the enforcement process is revealed.
The role of the Instruction on the Organisation of Compulsory Enforcement of Decisions as a procedural guideline for the actions of state enforcement officers is highlighted. Special attention is paid to the procedure for handling confiscated property, as defined by Resolution of the Cabinet of Ministers of Ukraine No. 1724, and the procedure for using funds from enforcement proceedings (Resolution of the Cabinet of Ministers of Ukraine No. 554).
The author analyses digital tools, in particular the automated enforcement proceedings system. It is noted that its introduction has contributed to increasing the transparency, objectivity and efficiency of the enforcement process. Emphasis is placed on the importance of electronic registers, automatic case distribution and deadline control. It is argued that modern legal regulation needs further improvement, taking into account practice and challenges.
