Analysis and evaluation of legal acts adopted during martial law in the context of the formation of the state's administrative and legal policy

Abstract

The article presents an analysis of regulatory legal acts adopted in Ukraine under the legal regime of martial law in the context of shaping the state's administrative and legal policy. The purpose of the article is to conduct a legal analysis of the aforementioned normative acts in terms of their effectiveness, legality, and compliance with the principles of a democratic rule-of-law state. As a result of the study, key regulatory acts adopted during martial law were identified; their content was legally analyzed, and the consequences of their implementation for Ukraine’s legal system were assessed. Proposals for the normative improvement of these acts were formulated. In the course of analyzing legal acts adopted under the legal regime of martial law, the article examines the legal nature of these documents, their conformity with the principles of the rule of law, international legal standards, and the Constitution of Ukraine. The peculiarities of the martial law legal regime are explored, and the effectiveness and legality of restrictions on constitutional rights are evaluated, along with changes in administrative, criminal, labor, and commercial legislation. The article highlights both the positive aspects of the adaptability of Ukrainian legislation and the problematic areas that require further legal refinement in the context of developing an effective administrative and legal state policy. Conclusions are drawn regarding the impact of these acts on the state’s legal system and society. Particular attention is paid to the issue of balancing national security with the preservation of democratic institutions. It is recommended that modern administrative and legal policy during wartime and the post-war period be based on a balance between national security and human rights, with a clear focus on democratic values and the rule of law.
