Administrative and Legal Regulation of Business in the Field of Mine Action

The scientific article is devoted to establishing the features of administrative and legal regulation of business activities in the field of mine action. Legislative and regulatory acts that establish the legal framework for mine action in Ukraine have been examined. The scientific achievements of Ukrainian researchers who have devoted their work to the legal regulation of mine action have been utilized. The methodological basis of the study included special legal methods such as systemic, theoretical, and legal, formal and dogmatic, comparative and legal.
The definition of administrative and legal regulation of business in the field of mine action has been proposed as the establishment in legislative and regulatory acts of requirements for enterprises and organizations that wish to engage in mine action activities. The features of administrative and legal regulation of business in the field of mine action have been established: admission to mine action activities is conditioned by the procedure for passing the certification of enterprises and organizations that wish to engage in mine action activities; licensing of mine action activities is not provided for; the conditions and procedure for accreditation of conformity assessment bodies by the National Accreditation Agency of Ukraine have been established; the conditions and procedure for certification of mechanized demining equipment have been established; the powers of the Humanitarian Demining Center for public procurement of demining services for agricultural areas have been established.
Proposals have been developed to improve the administrative and legal regulation of business in the field of mine action activities: to introduce licensing of enterprises and organizations wishing to carry out demining instead of certification, to develop Licensing Conditions for Mine Action Activities, which will regulate the requirements for mine action processes and equipment used during demining, to provide in the legislation the powers of the Humanitarian Demining Center for public procurement of demining services.
