Administrative and legal principles of restriction and simplification of notarial procedures under conditions of war

Abstract

The military actions in Ukraine have necessitated the adaptation of notarial activity to extraordinary conditions, leading to the emergence of new administrative and legal approaches to regulating document authentication procedures, the performance of notarial acts, and the protection of citizens’ rights in situations with limited access to legal services.

 This paper analyzes the regulatory framework governing notarial activities during martial law, examines the specific features of implementing simplified procedures, temporary restrictions, and digital mechanisms for confirming legal actions. Particular attention is paid to the issues of legal certainty, protection of property rights, documentary confirmation of transactions, as well as administrative and legal means of ensuring the stability of the notarial system in conditions of armed conflict. The research aims to identify effective models of legal regulation that enable the continuity of notarial services while ensuring security and legal compliance during wartime.

The author concludes that the administrative and legal foundations for restricting and simplifying notarial procedures in wartime play a crucial role in ensuring the continuity of legal circulation and the protection of citizens’ rights. During an armed conflict, access to notarial services may be complicated by restrictions on movement, destruction of infrastructure, or the inability to physically visit notarial offices. The introduction of simplified procedures allows citizens to timely formalize transactions, powers of attorney, inheritance documents, and other legally significant acts, which ensures the stability of civil circulation and minimizes the risk of violations of property and non-property rights. The simplification of procedures does not diminish the level of legality but is aimed at optimizing administrative requirements and creating conditions for the prompt execution of documents.
