On the matter of definition of copyright in the era of artificial intelligence

The article examines theoretical, legal and practical issues raised by the need to apply copyright in the era of artificial intelligence. It is emphasized that the development of artificial intelligence technologies is one of the key characteristics of the current stage of human development, the result of a new scientific and technological revolution that is changing society and everyday life in the most basic aspects and in every area imaginable.
The research employs a set of general scientific and specialized legal methods, including the formal-legal, comparative-legal, and systemic-structural approaches, which made it possible to comprehensively analyze the transformation of copyright categories in the context of contemporary scientific and technological development.
The article examines basic approaches to the problem of copyright in the era of artificial intelligence. It is emphasized that appropriate legal regulation can only be possible if the fundamental concepts related to copyright, such as «author», «originality», «creativity», «intelligence», are carefully reviewed. The views of researchers on these concepts are considered, in particular in the era of artificial intelligence, as well as the main legal theories describing the essence and origin of copyright. An attempt is made to apply these theories to works that have arisen as a result of the use of artificial intelligence. Their inconsistency with reality, which arises with the advent of artificial intelligence, and the need for a fundamental revision in order to bring them into line with the actual requirements of legal regulation are emphasized.
The prospects for regulating copyright in the era of artificial intelligence as an individual human right, a machine right, or a hybrid right belonging to both a human and a machine are explored. It is emphasized that any of these fundamental paths will require, at least in part, a rejection of the human-centric approach to copyright and, probably, the concept of law as a whole as an entity that can belong only to a person. Specific cases are studied where the issue of recognizing copyright for objects of artificial intelligence had a decisive impact on the registration of copyright, as well as on the position of human authors regarding certain works. The insufficient regulation of the issues raised in these cases is indicated, which led to ambiguous and half-hearted results. It is concluded that the prerequisite for solving the problem of copyright in artificial intelligence is interdisciplinarity in the study of the relevant issues, which would combine the methods and achievements of law, philosophy, and other sciences.
