Rights and obligations of the parties to the contract for the provision of rehabilitation services

The scientific article is devoted to establishing the rights and obligations of the parties to the contract for the provision of rehabilitation services. This article examines the legislative norms governing civil-law relations in Ukraine, as well as the specific features of healthcare sector management in the country. The works of scientists who studied the procedure for concluding civil-law contracts, as well as the peculiarities of the content of contracts for the provision of medical and rehabilitation services, are studied.
The definition of a contract for the provision of rehabilitation services is proposed as an agreement between a patient and a rehabilitation institution, which provides for the provision of a set of measures to the customer on a paid basis, which are required by a person who is experiencing limitations in daily functioning in interaction with the external environment due to health conditions or aging. It is argued that the content of a contract for the provision of rehabilitation services must necessarily include the rights and obligations of the parties.
It is concluded that the obligations of a rehabilitation institution include providing quality rehabilitation services within the time frame established by the contract, involving the necessary rehabilitation specialists, ensuring the preservation of medical confidentiality, and providing the patient with information and medical documentation about rehabilitation services. The patient’s obligations include paying for rehabilitation services, following the medical prescriptions of the rehabilitation specialist, and adhering to the regulations of the rehabilitation institution.
It is emphasized that the rights of a rehabilitation institution may consist of receiving payment for rehabilitation services and terminating rehabilitation assistance in the event of a patient’s violation of the contract terms. It is argued that the rights of a rehabilitation institution patient may include receiving quality rehabilitation services and information about them, as well as the opportunity to choose a specific rehabilitation specialist. Attention is drawn to the fact that the patient has the right to refuse the provision of rehabilitation services before they are scheduled.
It is proposed to provide for the conditions for concluding a contract for the provision of rehabilitation services in a separate section of the Civil Code of Ukraine.
