Legal support of information policy in the field of budgetary financing of energy

Abstract

The article examines the legal support of information policy in the field of energy budget financing as a tool for ensuring the transparency of public finances and improving the efficiency of public administration. It is substantiated that the information policy has an interdisciplinary nature and combines the norms of financial, information and energy law. It has been proven that a key element of such a policy is data on financial transactions in the energy sector, which reflect the real movement of budgetary and private resources and serve as the basis for ensuring transparency, accountability and control.

The complex legal nature of these data, which combines the characteristics of public financial information, a strategic resource and a restricted access object, is determined. The need to balance between the openness of financial flows and the protection of sensitive information was emphasized. Special attention is paid to the transformation of information policy from traditional forms of control to algorithmic models of data management.

It is proposed to introduce the term «digital financial monitoring of the energy sector» as a new legal category reflecting the systematic use of digital technologies for the collection, analysis and verification of financial data in real time.

A complex of general scientific and special legal methods was used in the research process. In particular, a formal-legal method was used to analyze the norms of budget, information, and energy legislation, and a systemic-structural method was used to study the relationship between information policy, digital financial monitoring, and budget processes in the energy sector. Comparative legal and prognostic methods were also used to assess foreign approaches to the digitization of public finances and justify the prospects of introducing the concept of a «digital double» of budget flows in Ukraine.

It is proposed to amend the Budget Code of Ukraine by establishing the appropriate definition, which will contribute to the formation of a modern legal mechanism for managing financial flows in the energy sector. It was concluded that the development of digital tools for monitoring and algorithmic regulation allows to transform information policy from reactive to preventive, increasing the effectiveness of control, reducing corruption risks and ensuring the energy sustainability of the state.
