Legal basis, tasks and principles of activity of the military offce of law in the armed forces of Ukraine

Abstract

Nowadays, in order to ensure law and order, the Armed Forces of Ukraine face such major challenges as: annexation of part of the territory of Ukraine and the conduct by Russia of armed aggression in Donetsk and Lugansk regions, which needsappropriate counteraction; the introduction in the country of a special period, which provides for a certain procedure of militaryservice of law and order and ensuring military discipline; increasing the number of offenses in the military sphere and the like.All this requires the creation of a comprehensive and effective system of law and order in the Armed Forces of Ukraine and other military formations, whose main role is played by the Military Law Enforcement Service.A necessary step in strengthening military discipline is the creation of a unifed system of military law enforcement and other bodies that provide support for military discipline and prevention of offenses based on developed institutions of legal responsibility.

Strengthening law and order and military discipline are recognized by the Military Doctrine of Ukraine as one of the main areas of formation and development of the Armed Forces of Ukraine. Of particular importance in view of the above is the effectiveness of the military service of law and order, the most important tasks of which are to ensure the rule of law and to strengthen the rule of law, law and order and military discipline, to ensure the basic rights of military personnel.However, the diffculty in identifying law enforcement entities in the Armed Forces of Ukraine is created by the fact that their list is not legally defned. Therefore, the procedure for ensuring law and order in the Armed Forces of Ukraine and other military formations requires the presence of a coherent system of authorized entities, endowed with appropriate state governmental functions.
