Current Issues in the Implementation of the Right to Compensation for Damaged or Destroyed Real Estate by Foreigners who Have Immigrated to Ukraine for Permanent Residence

The article deals with the current issues related to the implementation of the right to compensation for damaged or destroyed real estate by foreigners who have immigrated to Ukraine for permanent residence. The provisions of the Constitution, international legal instruments, as well as civil and special legislation are analysed. In the course of the study, a systemic-structural approach, a legal-dogmatic method, an interpretation of legal norms, and a comparative law method were employed. It is established that immigrant foreigners are full participants in civil legal relations, have the right to acquire ownership of real estate, use and dispose of it, and are entitled to adequate legal protection in the event of its damage or destruction.
The analysis of national legislation and judicial practice made it possible to conclude that neither the procedure established by the Law of Ukraine No. 2923-IX nor the existing procedure for civil proceedings ensures effective protection of the right to compensation for damaged or destroyed real estate for foreigners permanently residing in Ukraine. The national compensation mechanism is inaccessible to them due to restrictions on the range of eligible persons; the judicial mechanism, although formally available following changes in the approach to jurisdictional immunity, remains ineffective due to the impossibility of enforcing relevant court decisions, while international mechanisms are characterized by a prolonged and uncertain implementation period.
It is proposed expanding the list of persons entitled to compensation for damaged or destroyed real estate under the Law of Ukraine No. 2923-IX, in particular by granting such a right to foreigners who have immigrated to Ukraine for permanent residence. This would contribute to ensuring the principles of equality, non-discrimination, and effective protection of property rights.
