Some aspects of the introduction of electronic court in administrative proceedings

Abstract

The article examines the introduction of electronic court in administrative proceedings. Due to the introduction of electronic court in administrative proceedings and in general there is a problem with its functioning. The experience of recent years shows that despite all the obvious benefits of e-litigation, the E-Court project has not gained wide popularity and its progress is extremely slow.

The subject of the study was the essence and advantages, problems of introduction of electronic court in administrative proceedings.

The article reveals the bases and tips for the introduction of e-court in legal proceedings in general. Because for the full functioning of the "Electronic Court" all participants, as a minimum, need to ensure the formation, review and movement of cases in court, storage of cases in electronic form, the ability to familiarize with case files in the electronic office.

During our research, it became clear to us that the e-court subsystem is an important and necessary step in the administration of justice in Ukraine. As of today, work has not yet started, but there is access to the subsystem. Generally, subsystem commissioning can cause delays in the resource life associated with the processing of EDS by numerous lawyers. Such possible problems should be considered by system developers and moderators.

However, being in the stage of implementation and practical testing, the E-Court project aims to optimize such important aspects of the judiciary as ensuring the right to trial, compliance with procedural deadlines, reducing the costs of litigation, publicity and openness, etc. At the same time, if the E-Court project is regulated by procedural law, including administrative procedural ones, and works in the same direction, then slowly, through trial and error, but still the E-Court subsystem will be put into operation and in the future it will greatly facilitate the work of the parties and the court.

Therefore, we believe that this topic is quite relevant and up-to-date regarding the global study, research, and implementation of the E-Court project.
