Legal regulation of lease of state and communal property in Ukraine

The article is devoted to the analysis of the peculiarities of the legal regulation of the lease of state and communal property in Ukraine in the light of the new Law "On the lease of state and communal property" No. 157-IX. The author focuses on the legislative innovations due to the adoption of the new law. The analysis of the current legislation on the study of the civil law nature of the lease agreement for state and communal property, the problems of its attribution to public relations is carried out. So the author sees it possible to consider the regulation of the lease agreement for state and communal property in accordance with the existing provisions of the legislation, since such are in force in the legislation of Ukraine.
The article analyzes the principles according to which the lease of state and communal property is carried out.
The features of the legal regulation of the conclusion and termination of the lease of state and communal property are investigated. The author reveals the features of the new design of the contractual part of this institute in the form of an approximate lease agreement for state and communal property, approved by the Resolution of the Cabinet of Ministers of Ukraine.
The article contains a number of proposals for improving the theoretical foundations of the concept of legal regulation of the lease agreement for state and communal property in the legal doctrine. Thus, the author notes that the legal regulation of the lease of state or communal forms of ownership has undergone a long development. Today, there is a rapid change in legal regulation and judicial practice in the lease of state and communal property, and therefore there is an urgent need to approve the correct definitions in this area.
