The concept of «members of the family» in the legislation of Ukraine and the European Union

In the conditions of the harmonization of the national legislation of Ukraine with the legislation of the European Union (hereinafter referred to as the EU), the study of key concepts that are used in certain branches of law or have an interdisciplinary nature acquires an urgent importance. One of these concepts is the concept of «family members», which is used not only in family law, but also in civil, housing, social security law, etc.
Clarification of clear and understandable criteria, which are the basis for granting a person the status of «family member» according to the norms of national legislation, will contribute to the transparency of its application in the realization by natural persons of the rights they have as family members. And the study of the concept of «family members» under the legislation of the EU and individual European countries will answer the question of whether it is necessary to implement the norms of European legislation into the current legislation of Ukraine in order to harmonize the understanding of this concept.
The purpose of the scientific article is to study the concept of «family members» in the conditions of harmonization of the national legislation of Ukraine with the legislation of the European Union.
The above study provides grounds for the conclusion that the legislation of Ukraine does not enshrine a single approach to the concept of «family members». As in the legislation of Ukraine, there is no single concept of «family members» in the legislation of the EU and individual EU countries. Supranational legislation of the EU includes «registered partners» and their direct descendants as family members. However, the norms of the EU directives have a recommendatory nature and are set out in a dispositive form, which allows preserving national and religious values in the understanding of «family members» in the legislation of Ukraine.
