Abstract

The administration of justice during martial law presents significant challenges and necessitates the adaptation of the judicial system to new realities. Military conditions require changes not only in logistics and court locations but also in legal procedures. The primary goal remains ensuring effective and fair justice while safeguarding fundamental rights and freedoms, which becomes particularly complex in crisis situations.

A key aspect of judicial adaptation is the safety of all participants, given the increased risk of physical violence and terrorist threats. The use of video conferencing emerges as a crucial tool, reducing security risks while maintaining judicial efficiency. Additionally, procedures must be adjusted to expedite case resolution, particularly in matters related to national security threats such as espionage and terrorism, without compromising defendants’ rights.

Maintaining transparency is essential to uphold public and international trust in the judiciary. Digital technologies, including remote hearings, facilitate broader participation by witnesses and experts who may face logistical or security challenges. The Ukrainian law on martial law provides a legal basis for these adaptations, enabling courts to function effectively under wartime constraints.

The implementation of digital judicial processes not only ensures continuity during wartime but also lays the groundwork for long-term modernization. These adaptations enhance accessibility, efficiency, and responsiveness, demonstrating the judiciary’s resilience while safeguarding justice and the rule of law in Ukraine.
