The article deals with the peculiarities of administrative liability for violation of the implementation of the people’s will and the established procedure for its provision.
The current status of the identification of administrative offences and the imposition of administrative liability on the example of local elections in 2020 is outlined. It is noted that there are currently negative trends in Ukraine concerning the imposition of administrative liability for the implementation of the people’s will and the established procedure for its provision, as evidenced by the judicial practice of local and appellate courts in cases related to local elections in 2020.
Ways to improve administrative liability for violation of the implementation of the people’s will and the established procedure for its provision are proposed, in particular: the amendment of the current Code of Administrative Offenses of Ukraine to increase liability in the form of an increase in fines for offences against the implementation of the people’s will and the established procedure for its provision; the increase of professionalism among the authorized officials who have the right to draw up protocols on administrative offences; orientation of judges to administer justice following the current legislation of Ukraine.
